- Your acceptance of this Agreement
This constitutes an agreement between you and St-Aubin avocat inc. (“STA”) and governs your use of the DROITimmobilier.ca blog and its content (collectively, the “Blog”). Each time you use the Blog, you signify your acceptance and the acceptance of any person you purport to represent (and for the purposes of this Agreement, the word “person” includes individuals and any type of organization, whether incorporated or not), without limitation or qualification, to be bound by this Agreement, and you represent and warrant that you have the legal capacity to accept this Agreement on your own behalf and on behalf of any person you purport to represent. - Absence of client-lawyer relationship
No client-attorney consultation or fiduciary relationship is created by this Agreement or your use of the Blog or if you communicate with a STA professional by email or through the Blog. - Lack of professional advice
The Blog is of an informational nature only and is provided for convenience only. The Blog is not intended to be a general or detailed statement regarding the subjects discussed, legal or other advice, or an offer to buy or sell any product or service. You should obtain appropriate and professional advice before acting or failing to act based on information provided on or through the Blog.
The Blog is not a tool for requesting legal advice or transmitting confidential information to STA. Information transmitted to STA through the Blog is not secure, cannot be treated confidentially and is not protected by attorney-client privilege; such transmission does not create any relationship or obligation of any kind. You should not send confidential or critical information over the Internet or by e-mail unless you have taken appropriate precautions, such as using encryption. - Authorized users and access
The Blog may only be used by individuals who are at least 19 years of age and who can legally form binding contracts under applicable law. The Blog may not be used by persons in territories where access to or use of the Blog, in whole or in part, may be illegal or prohibited. - Disclaimer and Exclusion of Liability

THE BLOG IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED REPRESENTATIONS, WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, DURABILITY, AVAILABILITY, TIMELINESS OF PUBLICATION, ACCURACY OR COMPLETENESS, ALL OF WHICH ARE DISCLAIMED BY STA TO THE FULLEST EXTENT PERMITTED BY LAW. STA WILL NOT BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY LOSS OR DAMAGE ARISING OUT OF OR IN CONNECTION WITH YOUR OR ANY OTHER PERSON’S USE OF THE BLOG. - Protection of personal information
STA collects, uses and discloses your personal information in accordance with the Privacy Policy of the Blog and electronic communications of DROITimmobilier.ca. By accepting this Agreement and each time you use the Blog, you consent to STA’s collection, use and disclosure of your personal information in accordance with the Policy in its current form without prior notice to you or any other person and without STA incurring any liability to you or any other person. - Ownership and Permitted Use of the Blog

Other product and company names and logos appearing on the Blog may be registered or unregistered trade names, trademarks or service marks of their respective owners. Any use of the trade names, trademarks, service marks and logos displayed on the Blog (collectively the “Marks”) is strictly prohibited, except as expressly provided in this Agreement. Nothing appearing on the Blog or elsewhere should be construed as granting, by construction, legal estoppel or otherwise, any license or right to use the Marks. - Other sites
To make it more convenient for you to use, the Blog may include links to other websites or to other resources or businesses operated by other people (collectively, “Other Sites”). Other Sites are independent from STA and STA has no responsibility for, and has no control over, any other sites, their businesses, goods, services or content. Your use of other sites and your dealings with the owners or operators of other sites are at your own risk. - No framing, mirroring, scraping, data mining or display
You may provide a link from any other website (provided it is unframed) to this site, provided that you do not give the impression in any way that STA endorses or is associated with the other site (unless you have obtained our prior written permission). In the event that you create a link to our site, you must acknowledge the source (in which case, simply insert a link adjacent to https://droitimmobilier.ca/ which is clearly visible).
Furthermore, you may not reproduce or store any part of this Site on any other website without obtaining prior permission from STA. To obtain this authorization or consent, please contact STA at mstaubin@staubinavocats.ca. - Termination of this Agreement and Cessation of Use of the Blog
If you violate any provision of this Agreement, you may no longer use the Blog. STA may from time to time or for any reason and in its sole discretion, change, suspend or discontinue, temporarily or permanently, the Blog or any part thereof, or your permission to use the Blog, without notice to you or any other person and without liability to you or any other person. If this Agreement is terminated or your permission to use the Blog is terminated by you or STA for any reason, then: (a) this Agreement shall nevertheless continue to apply to and be binding on you with respect to your prior use of the Blog; and (b) STA may continue to use and disclose your personal information in accordance with the DROITimmobilier.ca Blog and Electronic Communications Privacy Policy as amended from time to time. Articles 5, 6, 7, 8, 9, 10, 11, 12 and 14 shall survive termination of this Agreement indefinitely. - Applicable law and dispute resolution
This Agreement, your use of the Blog and all related matters are governed solely by the laws of the Province of Quebec in Canada and the applicable federal laws of Canada, excluding any rules of private international law or conflict of laws that might lead to the application of other laws. Any dispute between STA and you or any other person relating to the Blog, this Agreement or any related matter shall be resolved before the courts of the Province of Quebec sitting in the City of Montreal and you hereby irrevocably submit to the original and exclusive jurisdiction of such courts with respect to any dispute or matter. Any claim or cause of action you may have relating to your use of the Blog, this Agreement or related matters must be brought in a court of competent jurisdiction in the Province of Quebec within six (6) months after the claim or cause of action arises, after which time it is barred. - Modifications to this Agreement
STA may, in its sole discretion, modify or supplement this Agreement as it relates to your future use of the Blog from time to time, for any reason, without prior notice to you or any other person and without STA incurring any liability to you or any other person. You may not modify this Agreement in any way. - Other questions
This Agreement, including any amendments that may be made to it from time to time, constitutes the entire agreement between you and STA with respect to your use of the Blog and supersedes all prior agreements, whether written, oral or otherwise, between you and STA with respect to your use of the Blog. If any provision of this Agreement is found to be unlawful, void or for any reason unenforceable, then that provision is deemed severed from the remainder of this Agreement and does not affect the validity and enforceability of any remaining provisions. The provisions of this Agreement are intended for the benefit of STA and its successors, assigns and related persons and for the benefit of you and your heirs, executors, administrators, successors, permitted assigns and personal representatives. You may not assign this Agreement or your rights or obligations under this Agreement without the express prior written consent of STA, which may withhold consent in its sole discretion. STA may assign this Agreement and its rights and obligations under this Agreement without your consent. No consent or waiver by either party to any breach or default by the other party in its performance of its obligations under this Agreement shall be deemed or construed as a consent or waiver of any continuing or other breach or default of such or any other obligations of such party. No consent or waiver shall be effective unless recorded in a writing signed by both parties.

Protecting the confidentiality of your information is of great importance to St-Aubin avocats inc. (“STA”). This policy explains how STA intends to collect, use and disclose the personal information that you may provide in the context of your use of DROITimmobilier.ca (the “Blog”) as well as in its electronic editions, newsletters and press releases (the “electronic communications”). The personal information you provide in particular on the Blog

Use of your personal information — STA may use your personal information to communicate and correspond with you, to respond to your inquiries or for any other reason permitted by law. Generally, STA will take into account the fact that you have voluntarily visited the Blog and that you have provided STA with preliminary information to let STA know that you consent to STA using this information for the purposes of following up on our communications with you and providing information such as electronic communications relating to our firm and our practice that may be of interest or useful to you.
STA Emails — If you provide your email address, STA may occasionally send you email messages about STA or DROITimmobilier.ca or any other topic that STA believes may be of interest to you. No link can be made between any tracking information contained in the reports and the identity or other personal information of individual users. STA may also link tracking information to personal information provided by Blog users. Once this link is established, all related information is treated as personal information and is only used and disclosed in accordance with this policy and in accordance with the laws.
Disclosure of Personal Information — STA may disclose your personal information to government agencies that are authorized by law to obtain such information, or where STA has reasonable grounds to believe that such information may be useful in the investigation of unlawful activity, or to comply with a subpoena, arrest warrant or order of a court, person or agency of competent jurisdiction requiring the production of information, or to comply with court rules regarding the production of records or information, or to protect STA’s rights and property. If STA undergoes a merger or other restructuring, it may disclose your personal information to the organization resulting from such merger or other restructuring.
Storage and Protection of Information — STA may store and process your personal information in Montreal, in the province of Quebec in Canada and in STA’s various offices in Canada. To protect the confidentiality of your personal information, STA uses security measures appropriate to the sensitivity of the information. However, due to the nature of the Internet and the technologies that result from it, the risks associated with security and confidentiality cannot be eliminated and STA cannot guarantee that your personal information will not be disclosed in a manner contrary to the provisions of this policy.
Access to your personal information — You may request access to your personal information and obtain information about STA’s collection, use and disclosure of this information by contacting STA at administration@staubinavocats.ca. STA uses privacy officers to ensure the protection of personal information and compliance with privacy laws in various jurisdictions. Your requests, once received, will be forwarded to the appropriate Privacy Officer. Subject to certain exceptions provided by law, you will be able to obtain reasonable access to the personal information we hold about you and you will have the right to challenge the relevance and accuracy of this information and to have it amended if necessary. STA assumes no responsibility for, and has no control over, these websites and other Internet resources or their collection, use or disclosure of personal information about you.
Blog Usage Agreement — The Blog Usage Agreement governing your use of the Blog (which can be viewed by clicking here) provides important provisions regarding the disclaimer and exclusion of liability of STA and third parties relating to your use of the Blog and provisions regarding the applicable law and exclusive jurisdiction for the resolution of any dispute that may arise out of such use. Each of these provisions also applies to any dispute that may arise from the application of this Policy and the collection, use and disclosure of your personal information, and have the same effect as if they had been reproduced directly in this Policy.
Former Users — If you cease using the Blog or STA terminates this authorization, STA may continue to use or disclose personal information about you in accordance with this Policy, as amended from time to time and subject to compliance with laws.
